Where is playing Daily Fantasy Sports legal?
Well, up until October of 2015 there really wasn’t much of a question…..

The massive media advertising of the two leading sites, Fan Duel and Draftkings at the beginning of the 2015 NFL season brought about not only massive awareness and new players–it also brought the attention of many state legislators and attorney generals to the daily fantasy phenomenon.
I have personally kept my opinions and thoughts to myself until now. I’m hoping to bring you as much information as possible on this subject and let you decide where you stand in regards to the Legality Question in the locality you are in.
Currently ( July 31, 2016) there are 7 states where playing Daily Fantasy for real money is strictly prohibited: Arizona, Hawaii, Iowa, Louisiana, Montana, Nevada and Washington State. There are no DFS sites operating in these states.
States currently (August 10, 2016) permitting daily fantasy sports without question are Colorado, Indiana, Kansas, Massachusetts, Maryland, Missouri, Mississippi, New York, Rhode Island, Tennessee and Virginia.
The Delaware Attorney General sent a letter to DFS sites to stop accepting paid fantasy contests on July, 8, 2016.
NY state passed legislation on June 22, 2016 legalizing DFS and has been awaiting the Governors signature. The Bill was signed and put into effect on August 3, 2016.
Pennsylvania is very close to regulation, playing DFS is still legal and unaffected in the Pennsylvania.
West Virginia AG pronounced most DFS contests as completely legal in WV on July 11, 2016.
Florida is served only by DraftKings and Fan Duel at this time.
There are several states where the Attorney Generals have deemed DFS as gambling as we speak, Illinois, Hawaii, Georgia, Vermont and Texas are included in this group.
Mississippi passed a law on April 19,2016 allowing DFS play until July of 2016 while the state reviews and compiles more extensive regulation.
The Attorney General in Alabama considered DFS illegal gambling on April 5th of 2016, during the opening week of Baseball. Legislation pending in Alabama on Daily Fantasy.
In Maryland, South Dakota and Florida the State Attorney Generals have questioned the legality of DFS or deferred legal opinion to Federal interpretations.
The Rhode Island States Attorney has ruled that DFS contests are completely legal in their states.
You can still play on DraftKings and Fan Duel in Illinois (legislation could be pending). A court case is pending in Illinois.
You can still currently play DraftKings in Texas, Fan Duel has suspended operations in Texas.
You can still currently play DraftKings and Fan Duel in Illinois.
Most smaller DFS sites have pulled out of Illinois and Texas and most of the questionable states already and will return when legalization occurs.
In general, the 2 main DFS sites, DraftKings and Fan Duel operate every where they possibly can.
Massachusetts has already outlined specific guidelines for DFS sites to follow and passed a law allowing full play on August 10, 2016.
Virginia passed legislation on March 8, 2016, Tennessee passed its law on April 20, 2016.
West Virginia has a bill that has passed the Senate and is moving forward. They may be next state in line for DFS legislative approval.
There are more than 20 other states, including CA, IL, FL and PA where DFS legalization and regulation legislation is being introduced in committees or being discussed by law makers.
As you can tell, there are many things in play in many states. In general when you sign up for a DFS site, you will be required to prove who you are and where you are located.
If you are in a prohibited State you will not be allowed to deposit and play.
You also should take most media reports (TV, Newspaper) with a grain of salt. There has been a great deal of negativity towards DFS by most news outlets (especially in NY). They honestly believe that we, the American people can not make a decision of how to spend our money, ourselves. But, it’s okay for people to spend $1000’s of dollars on State Run lotteries, where they have no influence on their chances of winning and on DFS you can influence your being a winner by using your own knowledge and skills to improve your outcomes.
